SB411 will be heard 7/5/11 at 1:30 by the Assembly Health Committee.  CAHSAH and NPDA have changed opposition of this bill to "opposed unless amended".  A significant number of agencies support this position (including all on the radio show).  The changes are to eliminate caregiver names on the website, move oversight to The Dept of Social Services because they oversee RCFE's (assisted living) instead of Public Health and to remove accreditation and caregiver certification.
 
Bill AB889 Died  but is suspected to be re introduce with a different bill number.

These bills are currently working their way through the CA Legislature. They have decided that they don’t want private industry competing with state bureaucracy. Our liberal law makers insist that the care industry needs to be further regulated by the state but their proposal will make private in-home care unaffordable for all but a very few. Seniors who could have stayed in their homes will needlessly be shifted to facilities at increased cost to the taxpayers of CA.

This affects every citizen of regardless of age. It’s about money, power, control and the ability for our seniors and their families to choose how and where they live. Under the guise of “helping” and “protecting” the state intends to take away the rights and options for care provided by private companies hired by seniors and their families. AB889 (Ammiano) – Domestic Work Employees
AB889 will be heard by the Assembly Standing Committee on Labor and Industrial Relations  July 6.  Talking Points
This bill would regulate the wages, hours, and working conditions of domestic work employees, which includes housekeepers, nannies, and caregivers for children, persons with disabilities, and the elderly. This bill would also provide a private right of action for a domestic work employee when those regulations are violated by his or her employer; provide an overtime compensation rate for domestic work employees; and would require annual pay increases and paid vacation for domestic work employees.

Note: Since when does government have the right to tell a private company to give employees annual raises and vacation time? Isn’t that part of the negotiation between employees and their boss?

Impact on the elderly: If you pay $250 a day to have someone live with your elderly parents 24/7 and this law passes the cost will be over $600. The new law requires they be paid 8 hours regular time, 8 hours time and a half, 8 hours double time for the same 24 hour period. . The company will have to cover the same time period with 3 different shift workers. Currently the worker receives room and board in addition to pay That is why the cost will go up so dramatically! The only alternative is a “changing of the guard” every 8 hours waking your parents up in the night and creating a lot of confusion.

STATUS: This bill was passed by the Assembly on June 2nd, and is being heard by the Senate Labor and Industrial Relations Committee July 6th. Committee Jurisdiction: Bills relating to labor, industrial safety, unemployment, workers' compensation and insurance, and non-certificated public school employees.

Note: Spoke with a staffer of this committee who is fairly certain this bill will sail through on party lines and come to the floor for a vote.

Bad News: June 28, 2011 - FYI SB411 passed the Assembly Human Services today.            Talking Points
 
SB411 (Price) - Home Care Services Act of 2011
Under existing law, a private provider of in-home care services is not subject to the requirements of a provider who works within the IHSS program. The bill would, among other things, prohibit a home care organization from hiring an individual as a home care aide unless that individual meets certain requirements, including, but not limited to, demonstrating that he or she has specified language skills, has completed required training, and cleared a criminal background investigation coordinated by the home care organization.
 
Note: IHSS is exempt from this bill.

 

Note: The criminal background investigation criteria is minimal at best. The only felony convictions that disqualify you from working in the industry are felonies against seniors and children. If you have raped, robbed or beaten a 30 year old you’re home free. Most private companies disqualify you if you have ANY felony conviction on your record. Now who is looking out for our seniors on this one?
 
Question: If IHSS and private companies provide similar services but one is subsidized by the CA taxpayer how long with the private industry last and how will that save taxpayer’s money?

 

Interesting note: IHSS workers are part of SEIU so who is really benefiting from this law? Hint: SEIU union dues accounts
 

Status: This bill passed by the Senate on June 2nd, and is currently being reviewed by the Assembly Committee on Human Services.

FYI:  In-Home Supportive Services
In-Home Supportive Services (IHSS) provides personal care and domestic services to persons who are aged, blind or disabled and who live in their own homes. IHSS is provided to those who otherwise might be placed in an out-of-home care facility but who can safely remain in their own home if IHSS services are received.
 
Regional centers have a mandate not only to serve persons with developmental disabilities, but to provide services in the most cost-effective manner possible. They are required by the Lanterman Act to use all other sources of funding and services before using regional center funds to provide services. Persons who receive services from a regional center and are eligible for IHSS are expected to use IHSS services available to them.
 
The In-Home Supportive Services (IHSS) program is administered by each county with oversight by the California Department of Social Services (CDSS). For application and eligibility information contact your local county welfare department, adult services section. Look for them in the county government section of your local telephone directory.
